Miao Shengming, Deputy Prosecutor General of the Supreme People’s Procuratorate, led a team to Shanxi province to survey the arrest review work on Aug 26. The team held a symposium at the Shanxi Provincial People’s Procuratorate to hear work reports and solicit opinions and suggestions. The team also conducted an on-site survey at the Yingze District People’s Procuratorate in Taiyuan, and held direct exchanges with frontline prosecutors.
Miao pointed out that procuratorial organs in Shanxi province have been committed to handling cases with high quality and efficiency, effectively performing their functions in arrest review, deepening coordination in investigation oversight, and continuously strengthening the guidance on investigation and evidence collection and supervision over litigation throughout the entire process. The quality and efficiency of arrest review have consistently improved, contributing significantly to the handling of complex and critical cases and maintaining social stability, he added.
Miao stressed the need to comprehensively analyze the new circumstances facing arrest review work, proactively respond to new challenges brought by changes in crime patterns, and firmly grasp the dual attributes of arrest review as both legal supervision and judicial review to accurately define its functional positioning.
He emphasized that efforts should focus on early involvement in major cases and guiding evidence collection and supplementary investigation. He urged procuratorial organs to comprehensively and accurately implement the criminal policy of tempering justice with mercy, accurately follow the statutory conditions for arrest review, and strictly perform functions in accordance with the law.
Miao also called for adopting a systemic approach to constructing a comprehensive and all-encompassing framework for the supervision and regulation of coercive measures in criminal proceedings, thereby enhancing the legal supervision over criminal litigation.
Xiong Wenhui, Chief Prosecutor of the Shanxi Provincial People’s Procuratorate, participated in the survey.
