SPP releases typical IPR protection cases

On April 25, the Supreme People's Procuratorate (SPP) released a batch of typical cases on the protection of intellectual property rights (IPR) during a press conference themed "intensifying the role of procuratorates in IPR protection to promote the development of new quality productive forces".

The cases are expected to serve as references for handling similar cases and better leverage the role of typical cases in promoting the publicity of laws and educating the public.

The nine cases released comprise six criminal cases, one civil supervision case, one administrative supervision case, and one related to public interest litigation. Six criminal cases cover the main types of IPR infringement, including trademark infringement, copyright infringement and trade secret crimes, demonstrating the effectiveness of whole chain punishment for IPR infringement throughout the whole chain.

The cases focus on the protection of core technologies in key fields to promote the development of new quality productive forces, reflecting procuratorial organs' intensified efforts in handling cases in the high-tech field. By punishing criminal activities, they safeguard the driving forces behind enterprises' innovation and creativity, creating a favorable environment for enterprise development.

The cases demonstrate the concept of protecting various entities on an equal footing in line with the law.

In carrying out IPR prosecution, procuratorial organs protect various market entities on an equal footing in accordance with the law, contributing to fostering an international market-oriented business environment governed by a sound legal framework.

By exercising penalties for IPR infringement and enhancing the supervision of civil litigation, they optimize the business environment and protect the legitimate rights and interests of various types of enterprises and entrepreneurs equally in accordance with the law.

The cases also demonstrate procuratorial organs' active efforts to promote the resolution of disputes from the source.

While fulfilling their duties in accordance with the law, procuratorial organs strive to address the incipient and tendentious social issues and management loopholes discovered during the process of procuratorial supervision. Through in-depth investigations and researches, and by offering suggestions and establishing cooperation mechanism, they work to promote the establishment of a collaborative IPR protection system.
