The Press Office and the Intellectual Property Procuratorial Department of the Supreme People's Procuratorate recently co-organized a new media tour of grassroots procuratorial organs across the country. The media delegation visited Shanghai's Pudong New Area on Sept 23.

The Pudong New Area People's Procuratorate, the Pudong New Area Intellectual Property Bureau and other participating units jointly issue a document titled "Eight Measures to Support and Safeguard the Sound Development of the Biopharmaceutical Industry in Pudong New Area" at the 2026 Zhangjiang Pharma Valley Industry Innovation and Development Promotion Conference in Pudong New Area.
The Pudong New Area People's Procuratorate, the Pudong New Area Intellectual Property Bureau and other participating units jointly issued a document titled "Eight Measures to Support and Safeguard the Sound Development of the Biopharmaceutical Industry in Pudong New Area" at the recently held 2026 Zhangjiang Pharma Valley Industry Innovation and Development Promotion Conference in the Pudong New Area. They also released four cases of judicial and law enforcement protection, as well as one cautionary case.
The cautionary case involved an enterprise that had failed to protect its rights and interests. In this case, the enterprise found that a patent application filed by a company established by its former employee after resignation bore a strong resemblance to its core trade secrets. However, the enterprise did not initiate rights protection proceedings until several years later, and the public security organ declined to file a case.
After the enterprise applied for supervision over case filing, the Pudong New Area People's Procuratorate reviewed the case and found that the statutory limitation period for prosecution had expired. It concluded that the public security organ’s decision not to file a case was proper and decided not to support the application for supervision.
An official from the Pudong New Area People's Procuratorate explained that much of the evidence in intellectual property (IP) infringement cases exists in electronic form and can be deleted or tampered with at almost no cost.
When enterprises discover that employees have stolen trade secrets, they often first seek to negotiate privately with the individuals involved and consider reporting the incident only after negotiations fail. By then, critical evidence, such as chat records, may already have been deleted. Procuratorial organs encounter such missteps, which lead to failed rights-protection efforts, almost weekly when providing IP-related legal services to enterprises.
The Pudong New Area People's Procuratorate has previously released similar cautionary cases through legal publicity campaigns and has also systematically compiled related cases into a risk warning database designed to help enterprises avoid risks in protecting their rights and choose optimal strategies for safeguarding their rights.
An IP legal counsel at a relevant enterprise said the released cautionary case not only clarifies what is protected by law but also guides enterprises on what actions to take and what evidence to preserve when their rights and interests are infringed.
