On Aug 19, Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the Supreme People's Procuratorate (SPP), held talks at the SPP with Zhang Zheng, Secretary of the Party Leadership Group and Vice‑President of the China Federation of Literary and Art Circles (CFLAC), and Zhang Hongsen, Secretary of the Party Leadership Group and Chairman of the China Writers Association (CWA). They discussed deepening exchanges and cooperation, strengthening intellectual property rights (IPR) protection in the literary and artistic fields, and leveraging the rule of law to support the country's building of a cultural powerhouse.
Ying pointed out that procuratorial organs, as the state organs responsible for legal supervision and judicial organs responsible for ensuring the unified and correct implementation of national laws, bear significant responsibility in strengthening IPR protection in the literary and artistic domains, safeguarding the legitimate rights and interests of writers and artists, and contributing to the prosperity of the country's cultural undertakings.
He added that the SPP will work with the CFLAC and the CWA to enhance routine communication and coordination, leverage their respective professional strengths and talent resources, and protect literary and artistic creation through the rule of law while promoting the socialist rule of law through literary and artistic endeavors.
Ying stressed the need to further strengthen IPR protection in the literary and artistic fields, with a focus on addressing high-impact infringements frequently reported by literary and artistic professionals, so as to foster a favorable creative environment.
He called for advancing comprehensive governance and focusing on legal research and compilation of typical cases in emerging areas such as digital copyright, artificial intelligence (AI), and online infringement, with a view to raising public awareness of IPR protection.
Furthermore, the SPP will further strengthen publicity and education on the rule of law, earnestly implement the Law on Rule-of-Law Publicity and Education, and produce more high-quality literary and artistic works themed on procuratorial work and the rule of law that achieve sound political, legal and social effects, Ying noted.
Zhang Zheng stated that pragmatic cooperation with the SPP will help literary and artistic organizations more effectively fulfill their role in safeguarding the legitimate rights and interests of literary and artistic professionals. He proposed jointly advancing institutional improvements, studying case-handling rules for new types of cases, addressing infringement issues, and exploring mechanisms for rights protection in cyberspace.
He also called for producing more procuratorial-themed artistic works that resonate with the public and advancing relevant internet legislation to support the nation's cyberspace governance strategy. He also stressed the importance of combating fraudulent IPR-related litigation to safeguard a sound environment under the rule of law.
Zhang Hongsen highlighted the growing ranks and fruitful achievements of writers within the procuratorial system, which demonstrate the value of literary creation focused on legal themes. At present, the rapid development of new forms of business such as AI, platform economy and digital copyright operations has brought new challenges to the protection of writers' rights and interests, including frequent copyright infringements, a complex online public opinion environment, and difficulties in AI‑related copyright governance.
He expressed the hope that the CWA and the SPP would deepen regular collaboration, advance the production of more procuratorial‑themed works, strengthen protection of the rights and interests of writers, and carry out publicity and education on the rule of law.
In July this year, the SPP and the CFLAC signed the Memorandum of Cooperation on Strengthening Intellectual Property Protection in the Literary and Artistic Fields, reaching consensus on six areas including the establishment of a regular communication mechanism.
Shi Weizhong, Deputy Prosecutor General of the SPP; Du Xueyi, a vice-ministerial-level permanent member of the Procuratorial Committee of the SPP; Li Xin, a member of the Executive Committee of the CFLAC; and Chen Erhou, a member of the Party Leadership Group of the CWA; as well as relevant department heads from the SPP, the CFLAC and the CWA, attended the discussion.
