The National Development and Reform Commission (NDRC) and the Supreme People's Procuratorate (SPP) have jointly released a batch of typical cases concerning the implementation of the Private Sector Promotion Law.
Comprising 10 cases, the release demonstrates the solid efforts of procuratorial organs in advancing the implementation of the law, fully exercising their procuratorial functions in accordance with the law, handling cases involving private businesses in a targeted manner, and serving and safeguarding high-quality social and economic development.
A prominent feature of the released cases is the comprehensive protection of the legitimate rights and interests of private enterprises through the performance of the four major procuratorial functions.
In criminal procuratorial work, procuratorial organs have conducted comprehensive evaluations of financial and communication evidence through specialized reviews and technical assistance, initiated supplementary prosecutions after identifying overlooked offenses and suspects, and lawfully punished internal corruption crimes within private enterprises.
In civil procuratorial work, procuratorial organs have identified civil enforcement measures that exceeded the scope of mortgage guarantee liability, supervising and rectifying them under the law.
In administrative prosecution, procuratorates have conducted in-depth investigations and verification of case facts via hearings, and addressed administrative penalties that violated the principle of proportionality by supervising relevant agencies to rectify irregularities through procuratorial recommendations.
In terms of public interest litigation prosecution, procuratorates have addressed the improper disposal of waste engine oil by urging regulatory authorities to fully perform their duties and rectify irregularities, promoting standardized governance across the industry while guiding private enterprises toward green development.
The released cases focused on addressing prominent issues in enterprise-related law enforcement and judicial practices. Procuratorial organs adopted multiple supervisory approaches in accordance with relevant laws and regulations, tailored to different scenarios, to enhance the quality and efficiency of legal supervision over litigation activities involving private businesses and operators.
Furthermore, while handling cases, procuratorial organs also focused on helping address difficulties faced by private enterprises, prioritizing the substantial recovery of losses as a key aspect of their work.
By upholding the principle of equal protection under the law, the released cases effectively contributed to fostering a fair, transparent, and law-based business environment. When handling cases, procuratorial organs paid close attention to soliciting opinions from various economic entities, analyzed systemic and institutional root causes, plugged regulatory loopholes, and promoted both immediate and long-term solutions to ensure sustainable improvements.
