The 16th National Procuratorial Work Conference was held in Beijing on July 16 to review the progress of procuratorial work over the past five years and outline the tasks for the current stage and future periods.
Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the Supreme People's Procuratorate (SPP), emphasized the importance of fulfilling procuratorates' duties as state organs for legal supervision to better serve the overall development of the country, administer justice for the people, and uphold the rule of law, thereby contributing to the building of a safe and law-based China at a higher level.
Ying highlighted the new development and progress in procuratorial work over the past five years, specifying that procuratorial organs nationwide have focused on serving high-quality development, delivering tangible procuratorial services for the people, strengthening procuratorial supervision to uphold fairness and justice, deepening procuratorial reforms to improve quality and efficiency in performance of duties, and promoting strict governance to build a highly competent workforce.
He stressed the need to consistently uphold the four major procuratorial functions — criminal, civil, administrative and public interest litigation — as the main framework for legal supervision on the new journey in the new era.
Ying also emphasized the importance of handling each case with high quality and efficiency to ensure that the public feels fairness and justice in every judicial case. This, he said, should be the fundamental value that procuratorial organs should pursue in case handling.
Furthermore, he called for deepening procuratorial reforms on the track of the rule of law.
Ying underlined the importance of upholding the absolute leadership of the Party over procuratorial work, strengthening confidence in the rule of law, and unwaveringly following the path of socialist rule of law with Chinese characteristics.
He urged accelerating the development of an independent knowledge system of Chinese procuratorial studies and continuously advancing the improvement of the socialist procuratorial system with Chinese characteristics.
It is important to align the implementation of Party policies with the enforcement of national laws, and fully leverage the power of the rule of law to ensure the effective implementation of the decisions and deployments by the Communist Party of China (CPC) Central Committee, he said.
Ying highlighted the importance of better coordinating development and security. While striving to maintain high-level security, he said, it is essential to implement a holistic approach to national security, with safeguarding political security as the top priority.
He urged procuratorates to proactively serve the country's high-quality development, uphold the socialist market economy order in accordance with the law, protect economies of all forms of ownership on an equal footing, strengthen judicial protection of intellectual property rights, and improve long-term mechanisms for standardized law enforcement involving enterprises.
Ying emphasized the need to promote efficient governance, giving equal importance to punishment and prevention so as to enhance governance while punishing criminals.
Procuratorial organs should enhance law-based handling of public complaints, facilitate the substantive resolution of conflicts and disputes through legal means, and help advance the modernization of social governance, Ying noted.
He also highlighted intensifying procuratorial protection of people's livelihoods so as to deliver tangible, accessible and beneficial procuratorial services to the public.
Ying called for advancing anti-corruption efforts in a coordinated manner, consciously integrating procuratorial work into the supervisory system of the Party and State, fulfilling duties of prosecuting duty-related crimes, and steadfastly following the path of anti-corruption with Chinese characteristics.
Furthermore, Ying reiterated the need to adhere to the basic positioning of legal supervision, improve the legal supervision system in keeping with the times, and give full play to the role of procuratorial supervision in the socialist rule of law system with Chinese characteristics. Comprehensive legal supervision over case filing, investigation, trial and enforcement should be strengthened to enhance the effectiveness of supervision, he said.
Ying noted that the basic functions of legal supervision should be reinforced to improve its precision, intensity and depth. Efforts should be made to strengthen review and approval of arrests and prosecution, improve the integrated arrest-prosecution case handling mechanism, and ensure the effective implementation of the quality and efficiency standards, he said.
He added that comprehensive supervision over criminal proceedings including filing, investigation and trial should be stepped up, alongside stronger supervision over procedural violations during trials and the execution of effective civil and administrative judgments.
Ying stressed that full-scope supervision over criminal execution and whole-process supervision over civil and administrative enforcement should be enhanced to ensure the fair execution of judicial judgments and the tangible delivery of judicial justice. Procuratorial public interest litigation should be strengthened to continuously improve effectiveness and standardization, better safeguarding national interests and public interests, he added.
Ying called for enhancing capacity for procuratorial investigation, with solid efforts in direct investigations, mobile investigations, and self-initiated supplementary investigations to improve overall supervisory effectiveness.
He pointed out that the basic approach of legal supervision should be optimized to deliver more substantive results through the law-based and standardized application of supervisory tools including appeals, corrective opinions, procuratorial recommendations and opinions to build a comprehensive system of duty performance spanning from supervisory procedures to supervisory outcomes.
Basic safeguards for legal supervision should be strengthened, and a high-quality and efficient case handling institutional framework should be established, he said, calling for continuously improving mechanisms for realizing and evaluating judicial justice throughout the procuratorial process.
Ying emphasized the need to firmly establish and practice a correct understanding of governance performance, implement and improve the judicial accountability system, and strengthen the checks and oversight over the exercise of procuratorial power. He also called for efforts to continuously deepen procuratorial reforms, enhance the professional skills and capabilities of prosecutors, and accelerate the development of digital procuratorial work.
