On May 28, the Supreme People's Procuratorate released 10 typical cases on strengthening procuratorial supervision to prevent and address juvenile delinquency.
These cases focus on prominent and challenging issues concerning the protection of minors that have attracted widespread public attention, including new types of drugs, cybercrime, and the mandatory reporting mechanism. They demonstrate procuratorial organs' performance of legal supervision duties, while enhancing public awareness that "prevention is protection, and punishment is also a form of rescue."
The released cases also present procuratorial organs' proven practices in law-based punishment, targeted correctional education and rehabilitation, protection of legitimate rights and interests, application of digital and intelligent technologies, and collaborative governance, providing practical examples for handling every juvenile-related case with high quality and efficiency.
The cases reveal that gang formation and repeat offenses are common in juvenile delinquency and remain persistent challenges in correctional education and rehabilitation. Meanwhile, the abuse of new addictive substances has become a prominent issue in minor protection in recent years.
They also highlight new traits of juvenile cybercrime in the digital era and extensive public attention on preventing and addressing indecent assault against minors.
Furthermore, the cases underscore the approach of "governance driven by case handling", whereby procuratorial organs advance comprehensive governance through law-based case handling.
The released cases focus on the thorough and precise implementation of the criminal policy of tempering justice with mercy, and properly balancing punishment and protection.
Procuratorial organs are actively promoting the establishment and improvement of a tiered and categorized intervention mechanism featuring differentiated measures, clearly defined priorities, and coordinated follow-up actions. While imposing punishment in accordance with the law, they also strengthen personalized education and rehabilitation, delve into the root causes exposed by cases, promote social governance through individual case handling, and eradicate factors that trigger juvenile delinquency at the source.
