SPP urges private enterprises to make law-based, standardized management a core competitiveness

On May 20, which marks the first anniversary of the implementation of the Private Sector Promotion Law, nearly 100 participants of the third session of the Legal Literacy Training Program for Private Entrepreneurs in the New Era visited the Supreme People’s Procuratorate (SPP) for hands-on learning activities. The event was attended by Shi Weizhong, Deputy Prosecutor General of the SPP, and Luo Laijun, Vice-Chairman of the All-China Federation of Industry and Commerce.

During the event, officials from the SPP's Procuratorial Department for Economic Crime provided an in-depth explanation of measures to implement the law, focusing on progress made by procuratorial organs in advancing the special campaign on supervising illegal cross-jurisdictional law enforcement and profit-driven law enforcement and judicial practices.

Articles 62 to 65 of the Private Sector Promotion Law clearly provide for case filing supervision, supervision over compulsory measures, rectification of intervention in civil and economic disputes through criminal means, and the regulation of cross-jurisdictional law enforcement in enterprise-related criminal cases. The ongoing special campaign on supervising illegal cross-jurisdictional law enforcement and profit-driven law enforcement and judicial practices carried out by procuratorial organs closely aligns with these articles.

Article 66 of the law authorizes procuratorial organs to practice measures such as filing protests or putting forward procuratorial recommendations to keep channels open for private enterprises to file appeals and complaints, so as to strengthen the judicial protection framework for private businesses.

In addition, the SPP has recently released a batch of typical cases on the equal and law-based protection of enterprises' legitimate rights and interests. These cases revealed patterns of corruption within private enterprises, characterized by a trend toward "occurring at the grassroots level and involving younger individuals", which has served as a wake-up call for the participants.

Participants also visited the People's Procuratorial Museum and the Procuratorial Technology Information Research Center.
