Typical cases released on linkage mechanism between deputies' suggestions, CPPCC members' proposals and public interest litigation procuratorial recommendations

The Supreme People's Procuratorate (SPP) recently released a second batch of 10 typical cases on the linkage mechanism between the suggestions from deputies to the people's congresses and proposals from members of the Chinese People's Political Consultative Conference (CPPCC), and procuratorial recommendations for public interest litigation.

In terms of case sources, six originated from deputies' suggestions and four from CPPCC members' proposals. In terms of case types, eight involved pre-trial administrative public interest litigation procedures, while two involved the filing of administrative public interest litigation cases.

The cases cover a range of areas, including the protection of intangible cultural heritage, agricultural product quality safety and the protection of State-owned assets.

The cases also spanned food safety, the protection of traditional villages, ecological water resource conservation, water environment treatment, and prepaid consumption.

During case handling, procuratorial organs utilized diverse methods such as issuing administrative public interest litigation recommendations, initiating administrative public interest litigation, organizing public hearings, and applying digital technologies. 

Starting from individual cases, they carried out supervision over similar cases, promoted industry governance, and provided important references for the revision and improvement of relevant local regulations.

The procuratorates' law-based handling of cases provided practical support for the supervision of people's congresses and the CPPCC's democratic oversight, which in turn drives the practice of public interest litigation by procuratorates, according to the head of the SPP's Public Interest Litigation Procuratorial Department.

This mechanism enables both sides to collaboratively fulfill their duties and promotes the effective implementation of the suggestions of deputies to the people's congresses, proposals from CPPCC members and procuratorial recommendations, thereby facilitating two-way linkage and transformation.

Moving forward, the public interest litigation departments of procuratorates nationwide will continue to deepen the practices of whole-process people's democracy, consciously accept the supervision of the people's congresses and the CPPCC's democratic oversight, and carefully consider deputies' suggestions and proposals from CPPCC members.

In addition, more efforts will be made to refine the mechanism for the two-way transformation of deputies' suggestions, CPPCC members' proposals, and the public interest litigation recommendations of procuratorates.

It's expected that such efforts will bolster high-quality development in public interest litigation and support specialized legislation on procuratorial public interest litigation.
