Ying Yong leads SPP delegation to ACLA for exchanges and opinion solicitation

On Jan 14, Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the Supreme People's Procuratorate, leads a delegation to the All-China Lawyers Association for exchanges and soliciting opinions. He Rong, Secretary of the Party Leadership Group and Minister of Justice, presided over the symposium held during the visit.

On Jan 14, Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the Supreme People's Procuratorate (SPP), led a delegation to the All-China Lawyers Association (ACLA) for exchanges and opinion solicitation, with a focus on supporting lawyers' law-based practice and advancing the building of a socialist country under the rule of law at a higher level.

During the symposium, Gao Zicheng, President of the ACLA, and several lawyer representatives, shared insights on relevant work and proposed opinions and suggestions based on their respective professional practice.

Ying emphasized that advancing the building of a socialist country under the rule of law at a higher level requires not only law-based performance of duty by law enforcement and judicial personnel, but also the lawful practice of the wider legal profession.

He stressed that procuratorial organs, as the country's legal supervision organs and judicial organs responsible for ensuring the unified and correct implementation of national laws, should safeguard lawyers' rights to practice law through handling cases and oversee any obstruction by law enforcement and judicial organs against lawyers' lawful practice.

Ying called for deeper collaboration between prosecutors and lawyers, including closer coordination in case handling, particularly in leveraging lawyers' roles in the leniency system for those who plead guilty and accept punishment. He urged the establishment of a regular two-way communication and feedback mechanism between procuratorates and lawyers' associations. By combining the strengths of both sides in resolving disputes, joint efforts should be made in legal interpretation, handling long-pending cases, and resolving disputes, so as to protect legitimate rights and interests of relevant parties and maintain social harmony and stability.

He also underscored the need to promote standardized and well-regulated performance of duty by prosecutors and lawyers, continuously foster a close yet clean relationship between both parties, and strictly comply with regulations preventing interference in judicial activities, including protocols prohibiting improper interactions between prosecutors and lawyers, in a bid to foster a sound environment for the administration of justice.

Ying called on lawyers, as a legal service group closely connected to procuratorial work, to continue offering valuable opinions and suggestions to help improve the work of procuratorates.

In her remarks, He Rong highlighted the critical role of lawyers in advancing the country's law-based governance and the shared responsibility of lawyers and prosecutors in promoting socialist rule of law and safeguarding social fairness and justice.

She urged judicial administrative organs and lawyers' associations at all levels to enhance lawyers' capacity to practice in accordance with the law and strengthen collaboration with procuratorial organs in enhancing law-based protection of lawyers' practicing rights.

She called for giving full play to the role of lawyers' associations in improving mechanisms and measures to ensure lawyers' rights to meet with clients, access case information, and have their opinions heard in accordance with the law, and to further regulate lawyers' practice to foster a favorable environment for the performance of their duties.

He Rong reiterated the need to deepen prosecutor-lawyer collaboration, improve regular communication mechanisms, and support lawyers' participation in dispute resolution, public interest litigation, and procuratorial supervision, so as to jointly advance the building of a law-based China at a higher level.

At the meeting, Ge Xiaoyan, Deputy Prosecutor General of the SPP, briefed participants on progress in prosecutor-lawyer collaboration and procuratorates' efforts in strengthening the protection of lawyers' practicing rights. Vice-Minister of Justice Wu Zeng provided an update on lawyer-related work.

Leading officials from relevant departments of the SPP and the Ministry of Justice as well as representatives of the ACLA attended the meeting.
