Role of procuratorial public interest litigation oversight in protecting livelihoods among influential cases of social law

On Jan 10, the Law School of Renmin University of China released the Top 10 Influential Cases in Chinese Social Law for 2025. Among them is the Supreme People's Procuratorate (SPP)'s deployment of multiple measures, including public interest litigation supervision initiatives aimed at strengthening safeguards for people's livelihoods.

According to the head of the SPP's Public Interest Litigation Procuratorial Department, in 2025 the SPP launched nationwide public interest litigation supervision campaigns focusing on the protection of workers' rights and interests.

During the 17th session of the 14th National People's Congress (NPC) Standing Committee, a report on the inspection of the enforcement of the Trade Union Law was reviewed. The 18th session of the 14th NPC Standing Committee deliberated the draft law on procuratorial public interest litigation, while the 19th session reviewed a work report submitted by the State Council on protecting the rights and interests of flexible workers and those in new forms of employment. These deliberations provided clear recommendations for improving the procuratorial public interest litigation system for protecting workers' rights and interests.

On Dec 25, 2025, the All-China Federation of Trade Unions, together with the SPP and the Supreme People's Court, jointly released typical cases on labor law supervision handled under the "one letter, two documents" system.

In 2026, procuratorial organs will strengthen procuratorial supervision and public interest litigation through concrete actions to improve the system for protecting workers' rights and interests, and intensify efforts to safeguard the rights and interests of workers in flexible employment and those in new forms of employment, ensuring all workers' legitimate rights and interests are effectively realized, safeguarded and developed, the official said.

The annual selection of the Top 10 Influential Cases in Chinese Social Law has been held seven times since its inception in 2018.
