Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the Supreme People's Procuratorate (SPP), held a symposium with a delegation led by Shen Ying, Deputy Head of the United Front Work Department of the Communist Party of China (CPC) Central Committee and Secretary of the Party Leadership Group of the All-China Federation of Industry and Commerce (ACFIC), on June 23 to discuss the implementation of the Private Sector Promotion Law, with a focus on ensuring equal legal protection of the private sector and fostering a law-based business environment.
Ying pointed out that the private economy is a crucial component of the socialist market economy, and its development and growth is an inherent requirement for upholding and improving the basic socialist economic system.
He said that since the 18th CPC National Congress in 2012, the CPC Central Committee has introduced a series of major initiatives to promote the development and growth of the private economy, including the enactment of the Private Sector Promotion Law, which has codified major policies and initiatives of the CPC Central Committee into legal norms to guide the sustained, healthy, and high-quality development of the private economy.
Ying stressed that procuratorial organs must adhere to the principles of equal treatment, fair competition, equal protection and common development, strictly handle cases in accordance with the law, ensure impartial administration of justice and strengthen legal supervision. Efforts should be made to carry out specialized investigation of irregular cross-jurisdictional law enforcement and profit-driven law enforcement to create a favorable rule of law environment for the healthy development of the private economy.
Ying further noted that ensuring equal protection of the legitimate rights and interests of various types of market entities and promoting the development of a law-based business environment are a shared responsibility of procuratorial organs and federations of industry and commerce.
According to Ying, it is necessary to deepen the implementation of the Opinions on the Establishment and Improvement of Liaison Mechanisms between Procuratorates and Federations of Industry and Commerce, enhance regular communication, optimize the mechanisms for transferring case clues, strengthen legal interpretations based on typical cases, and enhance the pertinence and effectiveness of legal services related to enterprises.
These efforts aim to better safeguard the legitimate rights and interests of private economic entities and operators, and empower private enterprises with the strength of the rule of law to boost their confidence, stabilize their expectations, and promote their development, he added.
Shen expressed appreciation for the long-standing efforts of procuratorial organs in promoting the rule of law in the private economy and supporting the work of federations of industry and commerce.
She acknowledged the SPP's efforts in serving the country's overall development, providing judicial services for the people, and striving for the development of the rule of law.
The SPP has consistently handled every case with high quality and efficiency and served the high-quality development of the private economy, earning widespread praise from private enterprises and private entrepreneurs, she said.
Shen said that federations of industry and commerce will deepen its communication mechanism with procuratorial organs, jointly promote the implementation of the Private Sector Promotion Law, facilitate communication channels between procuratorial organs and private enterprises, and guide private enterprises to operate in accordance with the law.
She also highlighted the need to establish and improve a modern enterprise system with Chinese characteristics, and effectively organize the conference on the development of the rule of law in the private economy, in a bid to promote the sustained, healthy, and high-quality development of the private sector.
