In order to enhance guidance on handling criminal cases involving endangering workplace safety and to address major challenges in procuratorial work, the Supreme People's Procuratorate (SPP) has released typical cases for offenses of hazardous operation.
The six typical cases cover three types of work situations violating safety management regulations as stipulated in Article 134 of the Criminal Law.
These cases span four high-risk industries, including offshore operations, metal smelting, light industry product manufacturing, and the operation, storage, and transportation of hazardous chemicals. They focus on refining the criteria for determining the reality, urgency and severity of hazards, and also emphasize the good practices and experiences of procuratorial authorities in handling such cases.
The SPP's Prosecutorial Department for Major Crimes pointed out that the newly released cases are exemplary in their respective fields, and they play a guiding and demonstrative role in unifying judicial standards across different regions and in accurately combating crimes in accordance with the law.
The procuratorial authorities will continue to intensify efforts in cracking down on criminal offenses that endanger workplace safety, rigorously review evidence, accurately ascertain facts, and correctly apply the law. They will collaborate with relevant departments to jointly advance workplace safety governance to promote the high-quality development of the economy and society with high-quality procuratorial duty fulfillment.
