SPP releases typical cases regarding IPR protection

The Supreme People's Procuratorate (SPP) held a press conference on April 23, focusing on enhancing high-quality intellectual property rights (IPR) prosecution to serve high-level technological innovation, where nine typical cases were released.

Liu Taizong, Deputy Director-General of the Prosecutorial Department for Economic Crime of the SPP, which also functions as the Prosecutorial Department for IPR, presented an overview of the cases. The cases span high-tech sectors such as advanced manufacturing and software algorithms, cultural domains like online literature and intangible cultural heritage, and areas concerning people's livelihoods, including traditional Chinese medicine and illegally labeled "special supply" liquor.

Liu highlighted procuratorates' commitment to aligning with the overall development of the Party and the nation and addressing the urgent needs and immediate concerns of the people, as well as their efforts to foster innovation-driven development, promote prosperity of the cultural sector, and improve the innovation and business environment through high-quality and effective performance of their procuratorial duties.

Emphasizing the pursuit of handling each case with high quality and effectiveness, these cases serve as guidance for frontline prosecutors to enhance the quality and effectiveness of case handling through rectifying omissions, conducting supplementary investigations, and other means.

One of the distinctive features of these cases is the comprehensive performance of the "four major procuratorial functions", where criminal, civil, administrative, and public interest litigation prosecutorial functions are concurrently carried out when handling IPR cases.

The newly released cases include six criminal cases related to trademark infringement, copyright infringement, and trade secret crimes, as well as three cases respectively in the field of civil supervision, administrative supervision and public interest litigation, showcasing the achievements in IPR prosecution in all fields.

In recent years, the SPP has continuously strengthened the institutional mechanisms for IPR prosecution. The digital prosecution strategy, technology-assisted case handling, cross-regional procuratorial cooperation, and other mechanisms are playing prominent roles in supporting and ensuring the effectiveness of case handling.
