SPP launches special campaign on supervision over illegal cross-jurisdictional and profit-driven law enforcement

The Supreme People's Procuratorate holds a meeting on March 26 to launch a special campaign on supervision over illegal cross-jurisdictional and profit-driven law enforcement.

The Supreme People's Procuratorate (SPP) has rolled out a work plan for procuratorial organs to conduct special supervision over illegal cross-jurisdictional and profit-driven law enforcement and administration of justice. It convened a meeting on March 26 to deploy the special campaign.

Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the SPP, spoke at the launch. Ge Xiaoyan, a member of the Party Leadership Group and Deputy Prosecutor General of the SPP, outlined the requirement for the special supervision work at the meeting, while Miao Shengming, a member of the Party Leadership Group and Deputy Prosecutor General of the SPP, presided over the meeting.

Ying noted that this special supervision campaign is a key measure to implement the Communist Party of China Central Committee's decision and plan on carrying out standardized enterprise-related law enforcement, and to promote the construction of a law-based business environment while fulfilling procuratorial obligations.

He described the special campaign as a practical measure to serve the overall development of the country, provide judicial services for the people, and take responsibility for the rule of law, as well as a key task for procuratorial organs nationwide to serve high-quality socioeconomic development.

Ying urged procuratorial organs at all levels to provide high-quality and efficient procuratorial services to safeguard the high-quality socioeconomic development of the country.

Ying stressed that the special supervision campaign must adhere to the principles of equality before the law, legality of crimes and punishments, and proportionality of punishment to the crime and liability. He further emphasized that any actions infringing upon the property rights and legitimate interests of sectors under all forms of ownership should be dealt with uniformly.

He called for focusing on prominent issues such as illegal cross-jurisdictional and profit-driven law enforcement and judicial practices, and strengthening supervision over the filing of criminal cases involving enterprises and mandatory measures such as sealing, seizure and freezing of property assets.

Ying underlined the need to rectify the cases where criminal means are used to intervene in economic disputes, to improve the mechanism for identifying and correcting wrongful cases involving enterprises in the procuratorial practice, and to prevent the linking of case handling with profits seeking.

Procuratorial organs should be proactive in self-supervision and rectify prominent issues in their own performance of duty and case handling, he said.

Ying further pointed out that procuratorial organs should carry out the special supervision under the overall coordination of the enterprise-related law enforcement campaign.

It is necessary to strengthen cooperation with disciplinary inspection and supervision organs, public security departments, courts, and administrative law enforcement agencies, to improve mechanisms for information sharing, transfer of clues, and analysis of similar cases, in order to jointly enhance the quality and efficiency of law enforcement and justice and address prominent issues in enterprise-related law enforcement and administration of justice, he said.

While urging procuratorial organs to perform their duties in an integrated and comprehensive manner in accordance with the law, Ying said that the SPP and procuratorates at the provincial level should intensify efforts in the handling of major cases, and strengthen supervision and guidance in case handling to ensure that the special supervision campaign yields tangible results.

In her speech, Ge outlined requirements for focusing on 11 key tasks and utilizing the four major procuratorial functions of criminal, civil, administrative, and public interest litigation to promote the clearance of enterprise-related criminal cases.

She said the special supervision campaign should combat false litigation, with an emphasis on investigating and prosecuting related criminal cases.

She further noted the necessity of strengthening supervision over the illegal seizure and freezing of business property during judicial activities, safeguarding the normal production and business operation of enterprises, she said.

Ge underlined the need to enhance supervision over administrative violations discovered in the performance of legal supervision and to promote the reverse transference between administrative and criminal cases in accordance with the law.

Efforts should be made to create a level-playing field and orderly market competition environment through public interest litigation, and strengthen the exploration of procuratorial functions in anti-monopoly and anti-unfair competition, in a bid to contribute to the construction of a unified national market, she said.

Ge also called for taking measures to investigate judicial officers involved in enterprise-related crimes and punish judicial corruption in accordance with the law in order to uphold justice.

The meeting was conducted via video link, with all the procuratorates at provincial level and the People’s Procuratorate of Xinjiang Production and Construction Corps participating. Leading officials from the SPP, permanent members of the Procuratorial Committee of the SPP, relevant officials from the Discipline Inspection and Supervision Team of the CPC Central Commission for Discipline Inspection and the National Supervisory Commission at the SPP, and heads of relevant departments of the SPP attended the meeting at the main conference venue.
