The Supreme People's Procuratorate (SPP) has issued five typical cases for supervising civil adjudication procedures, aiming to guide procuratorial authorities nationwide in effectively strengthening the oversight of unlawful practices, such as overdue case review, delayed rulings and extended case closure in civil cases, as well as the legal supervision of mandatory measures like personal safety protection orders and litigation preservation.
The initiative is designed to safeguard the legitimate litigation rights of the parties involved in accordance with the law, ensure substantive justice with procedural justice, and secure social fairness and justice.
The Civil Procuratorial Department of the SPP has stated that procedural justice is not only a crucial safeguard for substantive justice but also a significant manifestation of judicial fairness.
Ying Yong, Secretary of the Party Leadership Group and Prosecutor General of the SPP, repeatedly emphasized that it is important to ensure fairness and justice in both substance and procedure. Procuratorial authorities, based on their legal supervisory functions as stipulated by the Constitution and laws, should perform their duties in accordance with the law, effectively safeguard the litigation rights of parties and other participants, and supervise and rectify illegal procedural behaviors in trials to ensure substantive justice through procedural justice.
The Civil Procuratorial Department also highlighted that the law-based supervision of civil adjudication procedures is a vital part of the civil procuratorial duties. Procuratorial authorities are required to supervise unlawful practices such as exceeding the time limit for case review, rulings and case closure, and effectively strengthen the legal oversight of mandatory measures like personal safety protection orders and litigation preservation.
In addition, the procuratorial organs should further standardize the delivery of civil litigation documents, continuously reinforce the legal supervision of cases involving false civil and criminal lawsuits, closely collaborate with public security agencies, courts and judicial administrative organs, and conduct law-based oversight of civil adjudication procedures.
They must also empower the supervision of civil adjudication procedures with digital tools, exercising investigative verification rights and conducting evidence collection and review effectively.
It is essential to strengthen supervision over cases and individuals involved to uncover potential deep-seated violations, the department said.
It is also crucial to identify patterns from individual cases, facilitate the substantive resolution of conflicts and disputes promptly, and actively promote the modernization of the national governance system and capacity, it added.
