The Supreme People's Procuratorate (SPP) has released five typical cases on a regularized campaign against organized crimes and evil forces by procuratorial authorities. Through case analyses, the SPP aims to provide guidance on handling complex legal issues such as the identification of illegal control characteristics of organized crime groups and the disposal of assets involved in gang-related crimes.
The newly released cases cover common high-incidence areas of organized crimes and related evils, including the operation of casinos, predatory lending and illicit market circulation. Procuratorial authorities, in collaboration with public security agencies, have intensified efforts in the finding and verification of clues and risk assessment in handling cases to ensure timely investigation and precise prosecution.
Crimes involving mafia-like organizations often exhibit characteristics of diversified sources of assets, varied forms of assets, and complex legal relationships. Regarding the disposal of assets involved in organized crimes, the Anti-organized Crime Law enacted in 2021 sets forth a high-probability standard for determining the nature of assets related to organized crimes. However, it has become a new challenge in judicial practice to accurately understand and apply this standard.
In the cases released, procuratorial organs accurately identified the scope of assets linked to organized crime groups and proposed recommendations for the recovery of assets involved in criminal activities in accordance with the law.
The anti-organized crime office at the SPP stated that, in the next phase, procuratorial authorities will resolutely crack down on gang-related crimes with strict law enforcement, enhance the handling of cases in key areas, and firmly prevent the resurgence of organized criminal forces in rural areas and in activities involving pornography, gambling and drugs. They will intensify supervision over case filing, investigative activities and judicial proceedings, rigorously implement the unified case review mechanism at the provincial level, and ensure that cases are handled with high quality and efficiency.
