The main functions of the Supreme People's Procuratorate (SPP) are as follows:
1. to deeply implement Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, follow the lines, policies, and arrangements of the Communist Party of China (CPC), unify the thinking and actions of procuratorial organs, adhere to the absolute leadership of the CPC over procuratorial work, and firmly safeguard the core status of General Secretary Xi Jinping in the Party Central Committee and the entire Party, and resolutely uphold the authority and centralized, unified leadership of the Party Central Committee.
2. to propose bills to the NPC and its Standing Committee in accordance with the law, request legal interpretations of laws to the NPC Standing Committee, and request the review of the constitutionality of administrative ordinances and regulations, local regulations, autonomous ordinances, and separate ordinances to the NPC Standing Committee.
3. to lead the work of the people's procuratorates at all levels and specialized people's procuratorates. It provides guidance on the work of the procuratorates at lower levels, formulates overall guidelines and plans for procuratorial work, and deploys the tasks of procuratorial work.
4. to exercise the investigative power over criminal cases directly accepted by the SPP in accordance with the law, and lead the investigation of criminal cases directly accepted by local people's procuratorates at all levels and specialized people's procuratorates in accordance with the law.
5. to review and approve the application for arrest, make the decision on arrest, and initiate public prosecutions for nationally significant criminal cases in accordance with the law, and lead local people's procuratorates at all levels and specialized people's procuratorates to review and approve the application for arrest, make the decision on arrest, and initiate public prosecutions for criminal cases in accordance with the law.
6. to undertake criminal, civil, and administrative litigation activities that shall be undertaken by the SPP, and conduct legal supervision over the effective execution of legal documents related to criminal, civil, and administrative judgments and rulings.
7. to undertake the initiation of public interest litigations that shall be undertaken by the SPP, and lead the local people's procuratorates at all levels and specialized people's procuratorates to carry out public interest litigations.
8. to supervise the death penalty review activities of the Supreme People's Court.
9. to examine and decide whether to prosecute cases submitted for approval of prosecution by the provincial people's procuratorates
10. to undertake legal supervision on law enforcement activities in prisons, detention houses, and other places which shall be undertaken by the SPP, and lead the local people's procuratorates at all levels and specialized people's procuratorates to carry out legal supervision on law enforcement activities in prisons, detention houses, and other places.
11. to accept the accusations and appeals submitted to the SPP, and lead the local people's procuratorates at all levels and specialized people's procuratorates to carry out procuratorial work relating to accusations and appeals.
12. to examine the decisions made by the local people's procuratorates at all levels and specialized people's procuratorates in the exercise of procuratorial powers, and correct erroneous decisions.
13. to interpret specific legal issues related to the application of laws in procuratorial work, and issue guiding cases.
14. to guide theoretical research work in all procuratorial organs nationwide.
15. to undertake the team building and political work of procuratorial organs. It leads the people's procuratorates at all levels and specialized people's procuratorates in the management of procurators and other procutorial personnel in accordance with the law, coordinates with the central authorities in managing the institutional structure and personnel establishment of the people's procuratorates, formulates the measures for the management of relevant personnel, and organizes and guides the education and training of the procuratorial organs.
16. to coordinate with the central authorities in managing and evaluating procurator-generals of the procuratorates of the provinces, autonomous regions, directly administered municipalities, and specialized people's procuratorates, coordinate with the provincial Party Committees in managing and evaluating deputy procurator-generals of the provinces, autonomous regions, directly administered municipalities, and specialized people's procuratorates.
17. to lead the supervision over procuratorial work in the people's procuratorates at all levels and specialized people's procuratorates.
18. to plan and guide financial and equipment work in all procuratorial organs nationwide, and guide the procuratorial technical information work in all procuratorial organs nationwide.
19. to organize foreign exchanges and cooperation of procuratorial organs, and carry out international judicial assistance work.
20. to undertake other matters that shall be undertaken by the SPP.
